Privacy Policy

This Privacy Policy explains how CACTUS PAL LLC ("we", "us", "our") collects, uses, stores and protects your personal information when you visit www.cactuspaints.com (the "Site") or order a caricature from us. Please read it carefully. By using the Site or placing an order, you acknowledge that your personal information will be handled as described in this Policy. If we make material changes to this Policy, we will update the date below and, where appropriate, notify you directly.

1. Information We Collect

We only collect the information we need to create and deliver your caricature and to run the Site. This includes:

  • Order details. The options you select on the order form (drawing style, coloring, exaggeration level, body type, background, and the number of persons, animals, vehicles and props), your written drawing requirements, and the price of your order.
  • Contact information. Your WhatsApp number and/or email address, and your name if you provide it, so that we can communicate with you about your order and deliver the final artwork.
  • Photos. The reference photographs you send us. Photos may depict you and other people; it is your responsibility to have their consent before sending them (see our Terms of Use). Photos are used solely to create your caricature and are never used for marketing.
  • Payment information. Payments are processed by third-party payment providers such as PayPal or Stripe. We receive confirmation of your payment and basic transaction details (such as the amount, date and the name or email associated with your payment account), but we never receive or store your full card number or bank credentials.
  • Technical information. Like most websites, our servers automatically record basic technical data when you visit the Site, such as your IP address, browser type, device information and the pages you view. We use this to keep the Site secure and working properly.

2. How We Use Your Information

We use your information to:

  • review and confirm your order, and send you a payment request;
  • create your caricature based on your photos and requirements;
  • communicate with you about your order, including previews, revisions and delivery;
  • process payments and, where applicable, refunds;
  • keep accurate business and accounting records, handle complaints or disputes, and prevent fraud;
  • maintain the security and performance of the Site;
  • comply with legal obligations that apply to us.

We do not use your information for automated decision-making or profiling, and we do not send marketing communications unless you have expressly agreed to receive them.

3. Who We Share Your Information With

We do not sell or rent your personal information to anyone. We share it only with the service providers we rely on to operate, and only to the extent necessary:

  • Payment providers (such as PayPal and Stripe), who process your payment under their own terms and privacy policies.
  • Communication platforms. If you contact us or receive your artwork via WhatsApp, your messages are transmitted through WhatsApp, a service operated by Meta, and are subject to WhatsApp's own terms and privacy policy. The same applies to email delivered through our email provider.
  • Hosting and infrastructure providers that store the Site, your order details and your files on our behalf.
  • Our artists, who receive your photos and order requirements solely to create your caricature and are not permitted to use them for any other purpose.
  • Public authorities, where we are legally required to do so, or where disclosure is necessary to establish, exercise or defend legal claims.

4. How Long We Keep Your Information

We keep personal information only for as long as it is needed for the purpose it was collected:

  • Photos and artwork. The photos you upload and the artwork we deliver are stored for 365 days from the date of your order, after which they are permanently deleted and cannot be restored. You may request earlier deletion at any time after your order is complete (see Section 6).
  • Order and transaction records. Basic records of your order and payment are kept for as long as required by tax, accounting and consumer protection laws that apply to us.
  • Correspondence. Messages relating to your order are kept for as long as reasonably necessary to handle any follow-up questions, revisions, complaints or disputes.

5. How We Protect Your Information

We take reasonable technical and organizational measures to protect your information against loss, misuse and unauthorized access, including access controls limiting who can view your photos and order details. The Site is served over an encrypted (HTTPS) connection. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security; if a breach affecting your personal information occurs, we will notify you and the relevant authorities where the law requires it.

6. Your Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • the right to access a copy of the information we hold about you;
  • the right to correct inaccurate information;
  • the right to request deletion of your information, including your photos;
  • the right to object to or restrict certain uses of your information;
  • the right to receive your information in a portable format;
  • the right to lodge a complaint with your local data protection authority.

To exercise any of these rights, contact us at contact@cactuspaints.com. We will respond as soon as reasonably possible and within any timeframe required by applicable law. Note that we may need to retain certain information even after a deletion request where the law requires it (for example, transaction records for tax purposes).

7. International Transfers

We are established in United States, and the service providers we use (such as payment providers, hosting and communication platforms) may store or process your information in other countries. Where your information is transferred internationally, we rely on the safeguards offered by these providers, who are established global services with their own data protection commitments.

8. Cookies

The Site uses only the cookies and similar technologies necessary for it to function properly and securely. We do not currently use advertising or cross-site tracking cookies. If we introduce analytics or other non-essential cookies in the future, we will update this Policy and, where required, ask for your consent first.

9. Children's Privacy

The Site and our Services are intended for adults. We do not knowingly collect personal information directly from children. Caricatures may depict children only where the photos are submitted by a parent or legal guardian who has given their consent. If you believe a child's information has been provided to us without proper consent, contact us at contact@cactuspaints.com and we will delete it.

10. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or legal requirements. The "Last updated" date at the top of this page shows when it was last revised. Material changes will be highlighted on the Site, and your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
