These Terms of Use (the "Terms") govern your access to and use of www.cactuspaints.com (the "Site") and the caricature drawing services offered through it (the "Services"), operated by CACTUS PAL LLC ("we", "us", "our"). By placing an order or otherwise using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or place an order.

We create custom, hand-drawn digital caricatures based on photographs and specifications that you provide. Our Services are digital only: the final artwork is delivered as a digital image file to the email address or WhatsApp number you provide when ordering. We do not produce, print, frame, or ship any physical goods. Nothing on the Site should be understood as an offer of physical products.
To place an order, you select your preferred options on the order page (drawing style, coloring, exaggeration level, body type, background, and number of persons, animals, vehicles and props) and submit your order details together with your reference photos and any written requirements. The price displayed at the time of ordering reflects the options you selected; requests made after the order is placed for additional persons, objects, backgrounds or other specifics may incur additional charges, which will always be communicated and agreed with you before any extra work begins.
An order is considered confirmed only once we have reviewed your order details and photos, sent you a payment request, and received your payment in full. We reserve the right to decline any order at our sole discretion, including orders whose reference material does not meet our photo requirements or whose requested content violates Section 6 below. If we decline an order that you have already paid for, you will receive a full refund.
Payment is made in advance through the payment methods offered at the time of ordering, such as PayPal or Stripe. All prices are stated in US dollars (USD) unless indicated otherwise. You are responsible for any fees, duties or taxes imposed by your bank, payment provider or local authorities in connection with your payment. We never receive or store your full card details; payments are processed by our payment providers under their own terms and security standards.
Orders are processed within one (1) business day of payment confirmation. Once you receive confirmation that your order has been processed, the drawing phase begins. Drawing time ranges from one (1) to fourteen (14) business days depending on the complexity of your order, including the drawing style, the number of persons and objects, and the level of detail requested. Business days exclude weekends and public holidays.
Preview versions and the final artwork are delivered digitally to the email address or WhatsApp number you provided. You are responsible for providing accurate, working contact details; we are not responsible for delivery failures caused by incorrect contact information, full inboxes, or spam filtering. Timeframes stated on the Site are good-faith estimates, and while we meet them in the vast majority of cases, they are not guaranteed deadlines unless expressly agreed in writing.
After the first version of your caricature is delivered, the revision phase begins. We offer a reasonable number of revisions free of charge, as determined in good faith by the artist, to bring the artwork in line with the details of your original order. Revision requests must relate to the specifications of your order as placed; requests that materially change the order (for example, adding persons, changing the drawing style, or replacing reference photos) are treated as new or additional work and may incur additional charges.
The artwork is considered final and accepted when both you and the artist agree that the delivered version faithfully reflects your order details. If, during the revision phase, we are unable to reach a version acceptable to both parties, you may request a refund in accordance with our Refund Policy. Once the final version has been delivered and accepted, the order is complete and no refunds are given, as the artwork is a personalized, made-to-order digital good. Full details, including the situations in which refunds are and are not available, are set out in the Refund Policy, which forms part of these Terms.
By submitting photos and other materials to us, you represent and warrant that:
We reserve the right to refuse or cancel any order whose reference material or requested content violates these requirements. It is your responsibility to follow our photo requirements when placing an order. If the photos you supply are unclear or of low quality, you acknowledge that the final artwork may differ from the persons or objects depicted, and modifications requested for this reason may be charged as additional work.
Upon full payment and delivery of the final artwork, you receive a worldwide, royalty-free license to use your caricature for any personal or commercial purpose, without any further fees owed to us. You may print, share, publish and reproduce your caricature freely.
We retain the right to display completed caricatures in our portfolio, on the Site, and in our marketing and promotional materials. If you prefer that your caricature not be used for these purposes, let us know at contact@cactuspaints.com at any time and we will honor your request. We will never use the original photographs you supply for marketing purposes.
All content on the Site itself, including its design, text, graphics and example artwork, is our property or used with permission, and may not be copied or reused without our prior written consent.
Photos you upload and the artwork we deliver are stored on our systems for 365 days from the date of your order, after which they are permanently deleted and cannot be restored. We recommend saving your final artwork in a safe place promptly after delivery. For details on how we handle your personal information, please see our Privacy Policy.
To the maximum extent permitted by applicable law, our total liability to you arising out of or in connection with an order or these Terms shall not exceed the amount you paid for that order. We are not liable for indirect, incidental or consequential damages, or for losses caused by events beyond our reasonable control. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any statutory rights you hold as a consumer.
We may update these Terms from time to time. The version in force at the time you place your order is the version that applies to that order. Material changes will be indicated by updating the "Last updated" date at the top of this page, and your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or an order shall be subject to the jurisdiction of the competent courts of United States, without prejudice to any mandatory consumer protection rules that apply in your country of residence.
